1. Identity of Seller

These Terms & Conditions govern the sale of products purchased directly at the BenQ / ZOWIE event booth.

2. Scope

These Terms & Conditions apply to all offers and purchases of products made at the BenQ / ZOWIE booth during the event. By purchasing a product at the booth, the customer agrees to these Terms & Conditions.

 

3. Products

Products offered for sale at the booth may include, without limitation, ZOWIE mice and mousepads. All product descriptions, specifications, prices, and availability are subject to change without prior notice.

Products are sold for personal use only unless otherwise agreed in writing by BenQ Europe B.V.

 

4. Prices

All prices displayed at the booth are in the applicable currency and include VAT or other applicable taxes, unless expressly stated otherwise.

BenQ reserves the right to correct obvious pricing errors. If a pricing error is identified before completion of the sale, the customer will be informed before the transaction is finalized.

 

5. Payment

Payment must be made in full at the time of purchase using the payment methods accepted at the booth.

A sales receipt or proof of purchase will be provided to the customer. Title to the product passes to the customer only after full payment has been received by BenQ.

 

6. Conclusion of Sale

A sales contract is concluded once:

  1. the customer selects the product,
  2. payment is successfully completed, and
  3. the product is handed over to the customer together with proof of purchase.

BenQ reserves the right to refuse a transaction where reasonably necessary, including suspected fraud, abuse, resale activity, payment issues, stock unavailability, or compliance reasons.

 

7. Delivery / Collection at Booth

Products are sold and delivered directly at the booth. No shipment obligation applies unless expressly agreed otherwise in writing.

Risk of loss or damage passes to the customer when the product is physically handed over to the customer at the booth.

The customer is responsible for checking the product quantity and visible external condition at the time of collection.

 

8. Returns and Right of Withdrawal

If the customer is a consumer within the meaning of applicable law, the customer may have a statutory right to withdraw from the purchase within 30 days without giving any reason, starting on the day the customer takes physical possession of the product, unless a statutory exception applies.

To exercise the right of withdrawal, the customer must notify BenQ by an unequivocal statement and provide at least:

  • name,
  • proof of purchase / receipt number,
  • purchased product(s), and
  • contact details.

 

Returned products must be sent back or otherwise returned to BenQ without undue delay and no later than 14 days after the customer has communicated the decision to withdraw.

Unless otherwise required by law, the customer bears the direct cost of returning the product.

The customer is only liable for any diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the product.

 

9. Exceptions to Return / Withdrawal

To the extent permitted by applicable law, the right of withdrawal does not apply to:

  • products made to the customer’s specifications or clearly personalized;
  • sealed products not suitable for return for health protection or hygiene reasons once unsealed; or
  • other products excluded from return under mandatory law.

For clarity, mousepads and mice sold in standard unopened retail condition are generally returnable unless an exception above applies or the law provides otherwise.

 

10. Defective, Damaged, or Incorrect Products

If a product is defective, damaged, or incorrect at the time of handover, the customer should notify BenQ booth staff immediately where possible, or contact BenQ support as soon as reasonably possible after purchase.

Nothing in these Terms limits the customer’s statutory rights in case of non-conforming goods.

 

11. Warranty

For new products, BenQ provides a warranty period of at least two (2) years from delivery, in line with the BenQ source terms and applicable consumer law. The product must conform to the contract, manufacturer specifications, and reasonable usability and reliability requirements.

This warranty does not apply to damage caused by misuse, accident, improper handling, unauthorized modification, or normal wear and tear.

Where permitted by law, BenQ may repair, replace, or otherwise provide an appropriate remedy for valid warranty claims. This clause does not affect mandatory statutory consumer rights.

 

12. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law, including liability for death or personal injury caused by negligence, fraud, or defective products where mandatory law applies.

Subject to the above and to the maximum extent permitted by law, BenQ shall not be liable for indirect, incidental, special, or consequential loss, including loss of profit, loss of business, or loss of opportunity where the products are used for commercial or resale purposes.

 

13. Personal Data

If BenQ collects personal data in connection with the sale, return, warranty claim, or customer support, such data will be processed in accordance with BenQ’s applicable Privacy Policy and data protection laws.

 

14. Complaints and Customer Support

Complaints, return requests, and warranty questions may be submitted to BenQ through its support channels:

For efficient handling, the customer should keep the original proof of purchase.

 

15. Governing Law and Jurisdiction

These Terms & Conditions and any purchases made under them are governed by Dutch law.

If the customer is a consumer, mandatory consumer protection rights under applicable law remain unaffected. If the customer is not a consumer, disputes shall be submitted to the competent courts where BenQ Europe B.V. has its registered office.

 

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
